Summary: The health crisis resulting from COVID-19 has highlighted the need to implement social cooperation mechanisms in the health (and, especially, pharmaceutical) field if we are to quickly overcome situations such as the one we have experienced since January 2020. In this paper we intend to reflect on the usefulness of the notion of the social function of property applied to the field of vaccine patents, taking as a starting point the events suffered by the entire population in the last almost two years, the current (and cumbersome) mechanisms of the TRIPS Agreements to address the medicine needs of certain States and the request led by India and South Africa for exemption from the application of certain parts of these Agreements for the duration of the health crisis situation and in order to promote mass vaccination of the population.
