However, in times of pandemic, voluntariness versus the obligatory nature of the vaccine arises with the same intensity as the struggle between individual and collective rights. In the case of nursing homes, autonomy is reduced to the minimum expression. It is the judges who substitute the will of the person, his representative or the family member or relative, abusing a mechanism exceptionally provided for the protection of the vulnerable. It is worth reflecting on whether the function of the judge is to vaccinate or if something fails when judges are forced to vaccinate.La libre autonomía de la voluntad ante una intervención sanitaria como la vacunación es un derecho que despliega sus efectos aun en el caso de menores y de mayores con capacidad modificada o disminuida de hecho. Sin embargo, en tiempo de pandemia la voluntariedad versus la obligatoriedad de la vacuna se plantea con la misma intensidad que la pugna entre el derecho individual y el colectivo. En el caso de las residencias de mayores la autonomía se reduce a la mínima expresión. Son los jueces los que sustituyen la voluntad de la persona, de su representante o del familiar o allegado, abusando de un mecanismo previsto excepcionalmente para la protección del vulnerable.
