Currently the main rule for international jurisdiction in the European Union is founded on Regulation 2201/2003. Its section 3 contains a wide number of grounds of jurisdiction for this purpose. The application of this Regulation has displaced the Spanish internal rules (section 22, Organic Act on the Judiciary 1985). Concerning the application of the mentioned Regulation, the Supreme Court has addressed some controversial issues related to the determination of the international jurisdiction of Spanish courts on divorces.Los divorcios internacionales son más numerosos cada día. En no pocas ocasiones existe un especial interés de las partes litigantes en presentar la demanda ante los tribunales de un determinado Estado, adquiriendo especial relevancia el fenómeno del forum shopping cuya finalidad es procurarse el foro más favorable, en particular en cuanto a la ley aplicable. En la actualidad en la Unión Europea la determinación de la competencia judicial relativa a divorcios internacionales se regula en el reglamento 2201/2003. Su artículo 3.° contiene un amplio número de foros al efecto. La aplicación de este reglamento ha relegado a un segundo plano la norma interna española contenida en el artículo 22 de la ley orgánica del poder judicial.
