Recent legislation and jurisprudence, mistakingly, have weakened popular actions in Colombia and have reduced the role of the collective right to administrative morality. This paper analyzes the preventive dimension of popular actions that is reflected in the protection of contingent damages and its relationship with the protection of administrative morality in cases of conflicts of interest. We conclude that the weakening of popular actions is unfortunate and that the popular action for administrative morality is an ideal mechanism to prevent conflicts of interest, to strengthen public administration, and to fight against corruption.Las acciones populares son el mecanismo de litigio colectivo que la Constitución Política Colombiana prevé para proteger derechos e intereses, entre ellos la moralidad administrativa. Para este evento, los ciudadanos cuentan con la posibilidad de demandar a las autoridades públicas y privadas en casos donde la ética pública ha sido amenazada o vulnerada, con el objeto de prevenir daños o restaurar derechos vulnerados. Recientes desarrollos legislativos y jurisprudenciales, de manera equivocada, han debilitado las acciones populares en Colombia y han reducido al mínimo el posible rol del derecho colectivo a la moralidad administrativa. Este artículo analiza la dimensión preventiva de la acción popular reflejada en el daño contingente y su relación con la protección de la moralidad administrativa en casos de conflicto de intereses.
