Purpose: The difficulty of achieving a prompt and efficient administration of justice is not only a guarantee and a constitutional right, but also becomes an instrument to achieve peace with social justice and respect for human dignity. It is necessary to identify the reason for the saturation of the judiciary in order to propose fundamental changes, beyond the type of prevailing procedural system. Description: The judicial history in Colombia has been marked by an endemic difficulty: congestion and delay in the resolution of conflicts, added to the growing demand of the judicial apparatus that has exacerbated the weak state capacity to respond with the expected promptness. To this end, solutions have been sought based on reforms of the procedural codes that would allow greater efficiency in the work, embedding orality as the definitive component to unblock the jurisdiction. However, years later the problem has not been solved and, in fact, has become more serious. Conclusion: The desired decongestion and judicial celerity will be achieved not only with the inclusion of brief procedural schemes, eliminating unnecessary rituals and superfluous acts, regardless of the form in which it is carried out (oral, written). Improving the judge's powers of direction, investment in physical infrastructure, increasing the number of personnel in the service of the judiciary, the commitment of judicial employees and officials, and greater vigilance in their work are, among others, the means to achieve judicial decongestion.

É necessário identificar o motivo da saturação do judiciário para propor mudanças fundamentais, além do tipo de sistema processual vigente. Descrição: A história judicial da Colômbia tem sido marcada por uma dificuldade endêmica: congestionamento e demora na resolução de conflitos, somados à crescente demanda do aparelho judicial, o que tem exacerbado a fraca capacidade do Estado de responder com a prontidão esperada. Para tanto, foram buscadas soluções baseadas em reformas dos códigos processuais que permitissem maior eficiência no trabalho, incorporando a oralidade como o componente definitivo para desbloquear a jurisdição. Entretanto, anos depois, o problema não foi resolvido e, de fato, se tornou mais sério. Conclusão: A desejada descongestionamento e rapidez judicial será alcançada não apenas com a inclusão de esquemas processuais curtos, eliminando rituais desnecessários e atos supérfluos, independentemente da forma em que seja realizada (oral, escrita). Melhorar os poderes de direção do juiz, investir em infra-estrutura física, aumentar o número de funcionários no judiciário, o compromisso dos funcionários e funcionários judiciais e maior vigilância em seu trabalho são, entre outras coisas, os meios para alcançar o descongestionamento judicial.Propósito: la dificultad de lograr una administración de justicia pronta y eficaz no solo constituye una garantía y un derecho constitucional, sino que también se convierte en instrumento para alcanzar la paz con justicia social y el respeto a la dignidad humana. Es necesario identificar la razón de la saturación del poder judicial que permita proponer cambios de fondo, más allá del tipo de sistema procesal imperante. Descripción: la historia judicial en Colombia ha estado marcada por una dificultad endémica: la congestión y el retraso en la resolución de los conflictos, sumados a la creciente demanda del aparato judicial que ha agudizado la endeble capacidad estatal para responder con la prontitud que se espera. Para ello, se han buscado soluciones a partir de reformas de los códigos procesales que permitieran mayor eficacia en la labor, empotrando la oralidad como el componente definitivo para desatorar la jurisdicción. Sin embargo, años después el problema no se ha resuelto y, de hecho, se ha vuelto más grave. Conclusión: la anhelada descongestión y celeridad judicial se logrará no solo con la inclusión de esquemas procesales breves, eliminando rituales innecesarios y actos superfluos, independientemente de la forma en que se surta (oral, escritural).
