These are generalizations which constitute the implicit background and sometimes the explicit premises of all evidential and interpretive reasoning of legal operators and lay people, but they are also potentially dangerous when assumed without the due theoretical precautions. In this paper, I’ll reconstruct Taruffo’s point of view and conceptual distinctions about “common sense presumptions”, trying to enrich his framework with some commentaries, examples, and objections.Uno de los temas recurrentes en la obra de Michele Taruffo concierne al análisis y a la crítica de la noción de “máximas de experiencia”. Estas generalizaciones constituyen el trasfondo implícito y, a menudo, las premisas explícitas de todas las inferencias probatorias y los razonamientos interpretativos tanto de los operadores jurídicos como de los legos. Sin embargo, se trata de elementos potencialmente peligrosos cuando se asumen o emplean sin las necesarias precauciones teóricas.
