Summary: The emergence and availability of new technologies have allowed citizens to take an active role in the traffic of information. Faced with the phenomena such as hidden cameras, fake news and, more recently, disinformation, it has become clear that the classical legal understanding of the diligence in freedom of information is not enough to respond to the new informational paradigm. It will be necessary to consider that public opinion is no longer only built from the already known institutionalized media, that those who report are not necessarily professional communicators and that, to achieve the veracity of the information, it will require higher levels of diligence and responsibility. Based on these phenomena, a new criterion has been established for weighing the degree of interference allowed against personality rights, as well as new regulation forms that provide the basis for a new legal understanding of freedom of information.
