In this sense, the fight against the shortage of housing may be considered as a reason of general interest to justify the imposition of strict authorisation regimes for the provision of a service which, in principle, should be freely exercisable. Furthermore, the judgment provides local authorities with a wide leeway to shape these restrictions of the freedom to provide services, as it understands that they are the public authorities best placed to assess and respond to the impact that this type of services may have on the supply of rental housing in their own territories. The Supreme Court has already made use of this doctrine to confirm the legality of the strict requirements imposed on the establishment of tourist accommodation by the city of Bilbao through its urban planning powers, on the understanding that it has as clear democratic legitimacy to do so. El Tribunal de Justicia de la Unión Europea, por medio de su Sentencia Cali apartments, ha reconocido la posibilidad de que los Estados miembros regulen el mercado de viviendas de uso turístico para tratar de garantizar el derecho a la vivienda de sus ciudadanos. En este sentido, la lucha contra la escasez de viviendas podrá considerarse como una razón imperiosa de interés general para justificar la imposición de severos regímenes de autorización a la prestación de un servicio que, en principio, debería poder ejercerse libremente. Además, la Sentencia deja en manos de los entes locales un amplio margen para configurar estos regímenes restrictivos de la libre prestación de servicios, pues entiende son las autoridades públicas mejor posicionadas para evaluar y responder al impacto que este tipo de servicios pueden tener sobre la oferta de vivienda en alquiler de sus respectivos territorios.
