The aforementioned means that, the new legal order should be framed in those States to imposing, balancing or submitting it to respect their national legal orders. In this contribution, it can be seen the up and down streams of the MERCOSUR´s law and its developing. Furthermore, this is going to help the public to understand the MERCOSUR´s system, its perspectives and challanges that it faces when enhancing teory and practice. The latter conduces to questioning about the hierarchy, interpetation and aplication of the law it has been created.El presente trabajo tiene como objetivo expresar algunas ideas para que quien lo lea pueda debatir y reflexionar sobre la importancia de pertenecer a un proceso de integración y la influencia de lo “jurídico” en su interior. En este sentido, el derecho producto de ese proceso se inserta en los diversos ordenamientos de los Estados Partes y genera un efecto cascada que es necesario contemplar, pero que una vez iniciado no conoce barreras, excepto las políticas. Esto significa que, el nuevo ordenamiento que se crea plantea su ubicación en el marco de esos Estados para imponerse, equipararse o supeditarse a los respectivos derechos nacionales. En esta contribución se podrán apreciar esos vaivenes en lo referente al derecho que emerge del MERCOSUR como sistema. Lo que facilitará al lector su entendimiento, las perspectivas y los desafíos a los que se enfrenta el bloque para lograr cumplir con su cometido de amalgamar la práctica con la teoría.
