Summary: The theory of objective imputation -from the paradigm of the protection of norms-, turns out to be a solid and adequate tool aimed at guaranteeing the areas of normative freedom promoted by our fundamental norm, as only those externalized action decisions will be prohibited. and public ones that imply the disturbing arrogance of a foreign organization environment, but not those private behaviors or that, already external, are irrelevant. In this way, it contributes to strengthening the assumptions that, an integral part of the constitutional scheme defined by our constituent in 1853, laid the foundations for considering the criminal issue as a central aspect of state public order, as a reflection of the fundamental core of values that define to an open or democratic society
