Sumario: The humanitarian crisis of migration should not be seen only because of the material treatment that migrants receive. Although it is true that it is the most inhumane, it also has the legal status in which they are found. Those mistakenly called undocumented are considered “illegal”, and as such, unworthy of rights analogous to those of the citizen. In the imaginary of the receiving countries, the migrant is not appreciated as a person who contributes to the wealth of a people, It is not seen as a subject that contributes to the economy, but as a burden, that is, as one more person who is being kindly allowed to earn money and provide public services. The negative is highlighted and the positive is hidden. These are the reasons why the legal instruments that, in the perspective of human rights, help improve the treatment of migrants.
