Whilst Costa v. ENEL is the starting point for most accounts of the primacy of EU law, the story of that lawsuit is still relatively unknown. What drove Flaminio Costa to sue his electricity provider over a bill of as little as £1,925 (about 22 euros today)? Why did the small-claims court of Milan decide to involve both the Italian Constitutional Court and the European Court of Justice in such a ‘petty’ lawsuit? Why did those two courts hand down rulings going in opposite directions? How did the lawsuit end when it came back to the Milan small-claims court? Relying upon previously undisclosed court documents and interviews with some of the actors involved, this article seeks to shed some light on the less-known aspects of the Costa v. ENEL lawsuit, against the background of electricity nationalization in Italy at the height of the Cold War, and to assess the contribution of that lawsuit and of its ‘architect’, Gian Galeazzo Stendardi, to the development of the doctrine of primacy of European Union law.

Qu’est-ce qui a poussé Flaminio Costa à poursuivre son fournisseur d’électricité pour une facture de seulement ₤1925 (environ 22€ aujourd’hui)? Pourquoi le juge conciliateur de Milan a-t-il décidé d’impliquer à la fois la Cour Constitutionnelle italienne et la Cour de justice des Communautés européennes dans une affaire aussi ‘insignifiante’? Pourquoi ces deux cours ont-elles rendu des décisions si différentes? Comment l’affaire s’est-elle terminée lorsqu’elle est revenue du Luxembourg? En s’appuyant sur des documents judiciaires non divulgués et sur des entretiens avec certains des acteurs impliqués, cet article vise à éclairer les aspects moins connus de l’affaire Costa contre ENEL, dans le contexte de la nationalisation de l’électricité en Italie au sommet de la Guerre Froide, et à évaluer la contribution de cette affaire et de son ‘architecte’, Gian Galeazzo Stendardi, au développement de la doctrine de la primauté du droit européen.Aunque Costa/ENEL es el punto de partida de la mayoría de los estudios realizados sobre el principio de primacía, la génesis procesal de este asunto es, en cierto modo, aún poco conocida. ¿Qué condujo a Flaminio Costa a demandar a su proveedor de electricidad por una factura de tan solo 1925 liras (unos 22 euros hoy en día)? ¿Por qué el Juzgado de Paz de Milán decidió involucrar tanto al Tribunal Constitucional de Italia como al entonces Tribunal de Justicia de las Comunidades Europeas en una cuestión aparentemente de escasa importancia? ¿Y por qué estos tribunales adoptaron decisiones tan diferentes? ¿Cómo terminaron las actuaciones judiciales internas tras la sentencia del Tribunal de Justicia?
