Provisions and services that are materialized through the conclusion of contracts between the State (through the competent administrative authorities for it) and organizations or individuals. It has been demonstrated however, that parties in state contracts have shown, on various occasions, a lack of regulatory compliance with the Constitution and Public Procurement Legislation. It is therefore pertinent for this study to identify the responsibilities of these parties regarding the legality of these agreements, investigating whether they are entered into, whilst being in violation of legal requirements pertaining to public administration regulationsA partir de la Constitución Política de 1991 se ha establecido que el Estado tendrá a su cargo el cumplimiento de los fines esenciales, con el propósito de asegurar a la sociedad la prestación adecuada de bienes y servicios; prestación que se materializa mediante la celebración de contratos entre el Estado (a través de las autoridades administrativas competentes para ello) y particulares.
