A system that affects the quality of employment, wages and the effectiveness of collective rights of workers. This paper carries out a cross-sectional study of such a relevant regulatory tendency, detecting the different lines of policy of the Law and normative solutions that underlie it and questioning about its possibilities and limits.La aprobación de normas reguladoras de los efectos laborales de la subcontratación de actividades productivas, con una llamativa proximidad en el tiempo y un claro paralelismo en cuanto a su orientación tutelar, en un buen número de países de América del Sur es expresión de la emergencia de una conciencia cada vez más clara en torno a los potenciales efectos adversos del recurso a esta fórmula organizativa sobre la calidad del empleo, los salarios y la efectividad de los derechos colectivos de los trabajadores.
