Summary: This article develops a brief history and analysis of the administrative contract, it is revealed from the theory as a different category of private law, where one of the parties is the public administration. Cuba is identified as the country in the American region with a deficit of research on the subject, however, today, there is a contractual relationship between the state and natural persons, adequately a new constitutional text was necessary, which allows knowing and resolve the claims of any natural or legal person who feels their right in administrative matters is violated, and the administrative contract may be within these. This study was prepared through materials and methods: review, analysis, complex methodology and analytical, historical, scientific research methods. The objective of analyzing the issue in Latin America from the chronological history has been fulfilled, it was demonstrated that there is an absence of research that accurately addresses this issue in Cuba, being the first country that assumed it in its laws, and as a suggestion we define the urgency in deepening, given the existing conditions and that underlies this contractual figure and consequently promulgate the Law on administrative contracts (or Law of contracting the public commission), and the inclusion of the concept of this administrative contract in this Law.
