Therefore, the exposition has been divided into three parts. The first defines the subject matter of this contribution. The second part begins by setting out the legal and political context of the aforementioned manifestations, and then analyses the case law that led to the famous Reichsgericht's decision on 4 November 1925. This judgement signified the consolidation of the judicial review in Germany and may be interpreted as the result of a confluence: a case law increasingly sensitive to formal constitutional problems converged with concerns about the challenges for private property arising from the great inflationary crisis. The work concludes by assessing the constitutional balance achieved by the Republic’s highest court after the hesitating reasonings of the lapse between 1921 and 1924.En este trabajo se analiza el surgimiento de un control judicial difuso e incidental sobre la constitucionalidad de las leyes federales en la República de Weimar. A tal fin se ha dividido el artículo en tres partes. En la primera de ellas se delimita con precisión el objeto de estudio. En la segunda parte se expone, para empezar, el contexto jurídico y político en que se produjeron las primeras manifestaciones de la facultad jurisdiccional y se analiza, a continuación, la jurisprudencia que allanó el terreno para la célebre sentencia de 4 de noviembre de 1925. Esta resolución, que supuso la consolidación definitiva del “derecho de control judicial”, puede ser interpretada como el resultado de una confluencia: la de cierta línea jurisprudencial marcada por una presencia cada vez mayor de consideraciones de índole constitucional con otra más preocupada por los desafíos para la propiedad privada derivados de la gran crisis inflacionaria.
