Summary: The increase in the participation of women in politics in nominations is not proportional to the number of women who access positions of democratic election. The amount of participation of women in politics may improve, but not in access to power. The objective is to determine the gender inequality of women in access to positions of democratic election; the probabilities of electoral victory, and from the legal and sociology point of view, to analyze the regulations related to the issue. The methodology is the mixed perspective, under a sequential design of variant dexplis in two quantitative and qualitative phases. The results show that gender inequality in politics persists, worsens and that the problem does not lie in participating in an electoral process (-0.40) for women, but in accessing (-5.15) to positions of democratic election; with a 2% probability of electoral success
