Summary: In this article I propose to analyze how the weight of evidence should be performed in criminal cases for crimes against sexual integrity from a gender perspective, considering international human rights standards of the Inter-American system and International Criminal Law. Likewise, I will analyze the apparent tension between guarantees of the criminal proceedings that assist the accused and the obligations of the State to prevent, investigate, punish and eradicate violence against women in addition to the right of the victim to receive humane treatment that avoid revictimization. Therefore, in addition to reflecting on how the gender perspective should be incorporated into the weight of evidence in cases of sexual violence, I propose to demonstrate that this does not violate any of the guarantees that assist the accused in criminal cases.
