All this makes to considere that these institutions are in crisis and lead to human decadence. But freedom and equality have led to the transformation and understanding of concepts. Being a pillar the autonomy of will, its power can shape the marriage contract and the essential cell of modern society.En la actualidad la familia y el matrimonio como habían sido concebidas por el Derecho han sufrido notables variaciones en sus aspectos más fundamentales. El matrimonio igualitario, las capitulaciones matrimoniales, la maternidad subrogada, las compensaciones económicas, las prácticas “swingers” y el divorcio unilateral, son apenas uno de las tantas realidades con la que se topan estas. Todo ello hace considerar que estas instituciones se encuentran en crisis y que llevan a la decadencia humana. Pero la libertad e igualdad han permitido la transformación e interpretación de los conceptos, en los que la realidad exige diferentes aplicaciones y entendimiento.
