Chile is part of the phenomenon of Environmental Constitutionalism developed in the Latin American region, so its Political Constitution contemplates the right of people to live in an environment free of pollution and establishes duties for the State regarding the Law and the protection of the environment. However, this formula has proved to be deficient, which merits a rethinking of environmental issues at a constitutional level. This work follows this path from the study of the projects of constitutional reform currently before the National Congress, with the aim of systematizing analyses at the service of a change that will be the basis for an adequate environmental legal framework, respectful of human rights and that will maximize the protection of the environment. |
