Summary: The present article analyzes various criteria emitted by the Inter-American Court of Human Rights in the area of migration, focusing both on those referring to the use of force by the individuals entrusted with pubic security and on the migrant population’s right to access to justice. It will consider the increase in external human mobility in Latin America that has resulted from poverty, violence, lack of development opportunities, abuses by those exercising public power, and organized crime. This is of interest due to the fact that those wielding power, in a generalized sense, display discrimination and racism, leading to segregation, exploitation, people trafficking, and homicide. The above-described situations must be approached from a human rights perspective, in order to protect all people, regardless of nationality. The methodology applied involved the use of documental sources, on which analytic-deductive, inductive, and comparative methods were applied to summarize/synthesize the discussions established around the recognition of the rights of unregularized migrants.
