Next, the text discusses this criticism in the light of Franz Neumann (2009; 2013), seeking to show that not all radical transformation is necessarily progressive, especially if we leave aside certain assurances present in the tradition of constitutionalism.Este artigo discute a visão de poder constituinte de Antonio Negri à luz da teoria do direito de Franz Neumann. O texto apresenta as características essenciais do constitucionalismo e a sua crítica por Negri (2015) no livro O Poder Constituinte. Para Negri (2015), o constitucionalismo tem como função central impedir a transformação social radical por meio da con- tenção do poder constituinte.
