The Third Section of the Council of State as guarantor of the processes that seek direct reparation of the victims that demands that they be repaired and that it be declared that an unlawful damage was presented either by the direct action or possible omission of state entities. That is why said entity has raised and developed a series of presumptions, which have served as the basis for granting and liquidating, and in some cases, for denying the recognition of alleged damages. This article presents a presentation of the most important assumptions raised and developed by the Council of State in order to analyze each one of them, in order to verify if they constitute true successes in favor of comprehensive reparation and the consolidation of a efficient justice and in accordance with the Social State of law, or if they represent an absurdity in the face of said ideals.

Por isso, a referida entidade levantou e desenvolveu uma série de presunções, que serviram de base para a concessão e liquidação e, em alguns casos, para a negação do reconhecimento dos supostos danos. Este artigo apresenta uma apresentação dos pressupostos mais importantes levantados e desenvolvidos pelo Conselho de Estado no sentido de analisar cada um deles, a fim de verificar se constituem verdadeiros sucessos a favor da reparação integral e da consolidação de uma justiça eficiente e em conformidade com o Estado Social de Direito, ou se representam um absurdo frente a tais ideais.La Sección Tercera del Consejo de Estado como garante de los procesos que buscan la reparación directa de las víctimas que exigen que se les repare y que se declare que se presentó un daño antijurídico bien sea por la acción directa u posible omisión de entidades estatales. Es por ello que dicha entidad ha planteado y desarrollado una serie de presunciones, las cuales han servido de fundamento para conceder y liquidar, y en algunos casos, para negar el reconocimiento de perjuicios alegados.
