In this article, we sought to identify how social hypercomplexity and the crisis of contract confidence impacted the vulnerability of consumers. Based on these assumptions, consumer vulnerability was studied in essential or existential contracts for the supply of treated water. The methodology used was descriptive-exploratory, with bibliographic and jurisprudential analysis. The most recent judgments of the Court of Justice of the State of Minas Gerais (TJMG) and of the Brazilian Superior Court of Justice (STJ) were interpreted. It was observed that, in these contracts, it is necessary to hire this service so that one has access to an essential good for consumers’ dignity, which makes them even more vulnerable.No contexto da pós-modernidade, as relações de consumo tornaram-se hipercomplexas por diversos fatores como a globalização, a revolução das formas de comunicação e a possibilidade de um consumidor, em qualquer lugar do mundo, poder negociar com empresas e pessoas de países diversos. Nesse artigo, buscou-se identificar como a hipercomplexidade social e a crise da confiança dos contratos impactaram na vulnerabilidade do sujeito consumidor. Partindo dessas premissas, foi estudada a vulnerabilidade do consumidor nos contratos essenciais ou existenciais de fornecimento de água tratada. A metodologia utilizada foi a descritivo-exploratória, com análise bibliográfica e jurisprudencial. Interpretou-se julgados mais recentes do Tribunal de Justiça do Estado de Minas Gerais – TJMG e do Superior Tribunal de Justiça –STJ.
