The objective of this investigation is to investigate the position assumed by the Constitutional Court in the review of the sentences instituted by constitutional actions when the litigious cause has been the right to water. The methodology used was that of the pure and basic legal research of the law, the information gathering techniques are the bibliographic record and the analysis matrices, which allow a content analysis to be carried out on the sentences that have emanated from the Constitutional Court with a legal position on water as a fundamental or human right of Colombians. We find that the Constitutional Court has established several positions on the relationship that water has with the life of natural beings, but above all in humans, considering that the lack of aqueduct service, for example, directly threatens the fundamental right to life. |
