The second question, the question in which this article is focused, is what is (or should be) the nature of the power of a Constituent Assembly? The answer that the practice of contemporary constitutionalism has given to that question is that such a power has a sovereign nature. My purpose is to show that that answer should be rejected. In advancing that argument, I will use as my main example the Colombian case and Article 376 of the Constitution of 1991.Para la teoría constitucional hay dos preguntas claves que surgen en cualquier discusión acerca de la creación de nuevas constituciones. Primero, ¿qué mecanismo debe utilizarse para el ejercicio del poder constituyente? La respuesta que la práctica del constitucionalismo contemporáneo le ha dado a esa pregunta es clara: la Asamblea Constituyente. La segunda pregunta, en la cual se centra este escrito, es: ¿qué tipo de poder posee (o puede poseer) una Asamblea Constituyente? La respuesta que la práctica del constitucionalismo contemporáneo ha ofrecido a esa pregunta es que dicho poder es un poder soberano. Mi propósito es demostrar que esa respuesta debe rechazarse.
