This model is identified by the construction of a bivalent and impoverished knowledge, for being limited to a polarized thinking in opposite to the philosophical revolution caused by the ontological-linguistic turn. Nowadays, it is still possible to identify these influences in cases such as “Unpolitical School Movement” that leads to the discussion about the influence of children's literature in the law university education and in the the formation of the theoretical common sense of jurists. Based on this issue, this essay proposes an ironic pedagogy as a powerful and emancipatory teaching tool, supported by Rorty's philosophy.No século XIX, a literatura infantil surge como um instrumento ideológico a serviço das classes dominantes, com a finalidade de formar indivíduos alinhados com as aspirações daquelas sociedades. Esse modelo é identificado pela construção de um conhecimento bivalente e empobrecido, por limitar-se a um pensamento polarizado que se opõe à revolução filosófica ocasionada pelo giro ontológico-linguístico. Na atualidade, ainda é possível identificar essas influências em bandeiras como, por exemplo, a da “escola sem partido”, o que conduz à discussão sobre a influência da literatura infantil no ensino universitário do direito e na formação do senso comum teórico dos juristas.
