Rather than using an expansive reading of ‘collusion’, the author of this article suggests an approach that works with the core and original intent of Article 101(1) TFEU: the fostering of independent conduct and prevention of market coordination. It finds this to be doctrinally undisputed and also consistent with longstanding competition policy debates, as well as an egalitarian notion of price that lays the foundation of the free market economy. On this basis, and considering given uncertainties, an operational notion of ‘collusive risk’ is put forward.En los últimos años, varios investigadores especializados en temas de competencia han evidenciado cierto temor por el surgimiento de la llamada ‘colusión algorítmica’. A este respecto, algunos de ellos han sugerido expandir los conceptos de ‘colusión’ y ‘acuerdo’ con el propósito de englobar los alcances de este tipo de coordinación. A diferencia de la mayoría de trabajos, la autora de este artículo propone una aproximación que se adecúe a la intención central y originaria del artículo 101(1) del Tratado de Funcionamiento de la Unión Europea: la promoción de conductas independientes y la prevención de la coordinación de mercados. Este artículo concuerda con que lo anterior es indiscutible doctrinariamente y también que se condice con los permanentes debates sobre políticas de competencia, así como con la noción igualitaria del precio que yace en las fundaciones de la economía de libre mercado.
