Thus, these practices, until before the enactment, merited only administrative sanctions imposed by Indecopi's Committee on the Defense of Free Competition. In this paper, the authors present some reflections on the compatibility of that Act with the Peruvian legal system. In this way, they substantiate why it constitutes an obstacle to the suppression of anticompetitive practices and increases the level of legal uncertainty for potential offenders.El 29 de agosto de 2020, en un intento por atender algunos de los reclamos de la población en el marco de la crisis sanitaria, el Congreso de la República del Perú aprobó la Ley 31040, Ley que modifica el Código Penal y el Código de Protección y Defensa del Consumidor, respecto del acaparamiento, especulación y adulteración, que tiene por objeto criminalizar la realización de prácticas anticompetitivas. Dichas prácticas, hasta antes de la promulgación, eran merecedoras únicamente de sanciones administrativas impuestas por la Comisión de Defensa de la Libre Competencia del Indecopi. En el presente artículo, los autores presentan algunas reflexiones sobre la compatibilidad de la referida Ley con el ordenamiento jurídico peruano.
