Summary: Through the analysis of the three judgments that focused the legal-political debate regarding the suitability of the Parot doctrine (STS 197/2006, of March 28; STC 57/2008, of April 28 and STEDH Asunto Del Río Prada v. Spain, dated October 21, 2013) and the exposition of the restorative justice model adopted in the Nanclares Meetings, this work exposes some of the deficiencies and dysfunctions of the punitive penal model and how the restorative paradigm is important benefits and advantages not only for the victims of the criminal act but for society as a whole.
