Summary: This work aims to analyse the general corporate duty of protection, the different risks (particularly, psychosocial risks), the effects on health and the preventive measures to be implemented in the area of teleworking, as well as the Spanish regulations in terms of occupational risk prevention in teleworking before and after COVID-19. To this effect, this analysis has been carried out with a systematizing, interpretative methodology which is proactive of lege ferenda, whose latest result is the analysis of the new preventive model suggested in Royal Decree 28/2020, 22th September (current Law 10/2021, 9th July) for teleworking, as well as its advantages and drawbacks. In short, the main idea developed in this work consists on highlighting the importance of an adequate preventive corporate policy with a view to implementing teleworking which, at the same time, is comprised of risk evaluation and preventive planning, formative and informative duties, adequate objectives, rights to rest and digital disconnection, as well as regular supervision of teleworkers’ physical and mental health.
