Sumario: This review article sets out the theoretical and legal arguments that make up the principle of Progressivity and its non-regressive mandate, in accordance with International Law and Colombian jurisprudence. Firstly, a theoretical foundation of the concept of "Progressivity" is made according to some scholars of fundamental rights: Robert Alexy (2002; 2009; 2014), Ronald Dworking (1989), Carlos Bernal Pulido (2008) and Christian Courtis (2006). Secondly, the reference to the non-regressive corollary is pointed out, where i) proportionality as a methodology for constitutional control in normative regression and ii) the position assumed by the Colombian Constitutional Court (hereinafter CCC) with respect to progressivity and regression. Thirdly, other meanings on the concept of progressivity in law are described, and finally the legal framework that has shaped the Principle of Progressivity in Colombian Law is reconstructed.
