Thus, the current situation in Colombia, due to legislative and jurisprudential evolution, is that there is no type of corporation in which the members have their responsibility capped at the limit of their investments.La estructuración de los diferentes tipos sociales como los tenemos hoy día se ha dado a través de acaeceres históricos en el derecho civil y mercantil, en ello ha tenido participación el precepto de limitar la responsabilidad de los socios al tope de sus aportes, en contravía con el principio fundamental de que toda persona debe responder por sus obligaciones con la totalidad de su patrimonio presente y aun futuro; principio que ha originado nuevamente la ilimitación de la responsabilidad de los socios en todos los tipos sociales, pues actualmente en Colombia gracias a la evolución legislativa y jurisprudencial, no existe ningun grupo societario en el cual los socios tengan limitada su responsabilidad al tope de sus aportes.
