Summary: In this research, a study is carried out on the role played by the woman who participates as a surrogate mother within the reproductive practice known as surrogacy, in order to know what her participation consists of, how it is carried out, risks and consequences that their health is exposed to the use of hormones and various treatments, to achieve pregnancy or gestation by contract; Similarly, legal situations that may take place from an unfinished legal regulation regarding the so-called surrogacy are studied, as well as the use of human assisted reproduction techniques. The effect of globalization and capitalism impulse to the development and proliferation of this reproductive modality is retaken, which gives rise to the free interplay of supply and demand; that makes a suitable field to celebrate surrogacy agreements with or without legal regulation in between, where in the event of any eventuality not foreseen in the contract, legal norm, or in the absence of this, irreversible consequences are given for all those involved, in particularly for the most vulnerable such as the surrogate mother and the newborn, therefore the importance of attending and going deep into this issue
