Summary: This paper collects and explains two court sentences that provide an insight into the actual object of the forceful expropriation concerning archaeological sites with specific legal protection, such as cultural interest designation. The author gives a positive assessment of these sentences, both innovative, and recalls that as early as 1983 he made a proposal for a legal reform in the same direction. The research also provides considerations on the prize or reward assigned by the Artistic and Cultural Heritage Laws to the discoverer of the site and to the owner of the land where an archaeological asset is located
