Sumario: Despite the fact that the obligation of guaranteeing the day register every single day by the businessman it is not so recent, the doubts about its efficacy have not dispelled, especially in sectors where the ways of organization and flexible jobs prevail. The actual rules do not promote the adaptation of labor law’s control resources to the new realities productives. In relation to the day register, the article 34.9 ET suffers from some generalities and indetermanicy which obstruct their efficacy. In addition, the recent approval of the RDL 28/2020 of remote work does not seem to provide any original element that permit to connect the control resources with the reality productive. Both rules do a call to the collective bargaining. Because of that, the collective bargaining have a significant role in order to promote the efficacy of the day register that permit to protect the workers rights and to avoid the uncertain working market.
