The Collective Agreement signed by Assodelivery (the main association of food delivery platforms) and Ugl (a minor union with far-right affiliations) regulates the employment relationship of the riders (cyclists who collaborate with online platforms to bring goods and meals to end customers), maintaining the current autonomy and operational flexibility of the messengers, but establishing a package of minimum and mandatory protections recognized to them. These workers, qualified as self-employed, are at the centre of a strong institutional and doctrinal debate, in which the Ministry of Labour and the main national trade unions also took part. In opinion of Labour Ministry the agreement is not valid because the union does not sufficiently represent Italy’s delivery workers and also does not comply with a 2019 labour law that requires delivery companies to pay out hourly wages, while Assodelivery’s agreement only guarantees payments per delivery. And the other hand, Italy’s largest unions Cgil, Cisl and Uil had decreed the agreement as a “fake improvement”, because it treated riders as autonomous workers. Nevertheless, the validity if the agreement is likely to be tested in court.

Nevertheless, the validity if the agreement is likely to be tested in court.El Convenio Colectivo firmado por Assodelivery (principal asociación de plataformas de reparto de comida) y el sindicato Ugl (sindicato minoritario de extrema derecha) regula la relación de trabajo de los riders (esto es, quien colabora con plataformas online en la entrega de bienes y comida), manteniendo la actual autonomía y flexibilidad organizativa de los riders, pero estableciendo una serie de tutelas mínimas. Estos trabajadores, calificados como autónomos, se colocan en el centro del transcendente debate institucional y doctrinal, en el que participan incluso el Ministerio de Trabajo y los principales sindicales nacionales. Según el Ministerio de Trabajo, el Convenio Colectivo no es válido porque el sindicato no cuenta con una representación suficiente de los riders en Italia, y tampoco cumple con la ley 12872019 que establece que las empresas de reparto cuenten con una compensación mínima horaria, mientras que el acuerdo de Assodelivery sólo garantiza el pago en función de las entregas. Por otro lado, los sindicatos más representativos en Italia, Cgil, Cisl y Uil consideran el acuerdo como una “mejora falsa”, porque trata a los riders como trabajadores autónomos.
