These measures classified as precautionary measures aim to protect the jurisdictional monopoly granted by the parties to the arbitral tribunal to address the risk of two parallel proceedings and two contradictory decisions being issued. However, despite appearing to be a useful remedy in arbitral material, it has certain questions that diminish its application. In this article, the authors analyze such measures to address the questioning that limit its application to verify their efficiency and validity. It also assesses its requirements under international arbitration practice to corroborate whether they conform to the Peruvian regulatory framework.La Ley de Arbitraje se inspiró en la Ley Modelo de Arbitraje Comercial Internacional de la CNUDMI. Ambas normas facultan a los tribunales arbitrales a dictar medidas anti-proceso o anti-suit injunctions. Estas medidas calificadas como medidas cautelares tienen como función la protección del monopolio jurisdiccional otorgado por las partes al tribunal arbitral para así, afrontar el riesgo de que existan dos procesos paralelos y se emitan dos decisiones contradictorias. Empero, a pesar de aparentar un remedio útil en material arbitral, posee ciertos cuestionamientos que disminuyen su aplicación. En el presente artículo, los autores analizan este tipo de medidas para dar respuesta a los distintos cuestionamientos que limitan su aplicación con la finalidad de comprobar su eficiencia y validez.
