This article addresses the impacts of the decisions by the Brazilian State since the beginning of the COVID-19 pandemic and how these have affected the Brazilian federation. With that in mind, and from the use of the historical method, this work proposes that the impacts derived from this situation come from a different direction from what occurred since the promulgation of the 1988 Constitution, given that there is a decentralization movement that, at this moment, operates in the opposite direction to that of centralization —which had already stabilized and managed to thrive—, even in the jurisprudence of the Supreme Federal Court. This change in direction would be the result of the role of local governors and mayors in administrative and legislative decision-making, on the one hand, and the decisions taken by the Supreme Federal Court, on the other, which create expectations on whether such movements are merely occasional or might be setting a standard for the future of the Brazilian federation. To study this phenomenon, a bibliographic review, complemented with a thorough analysis of the national legislation, the distribution of competences enacted in the 1988 Constitution, and the recent jurisprudence of the Supreme Federal Court, was performed in order to build the theoretical framework that supports the results of this research. Consequently, this work highlights the lack of planning in the current decentralization process and the consequent intensification in competition between subnational entities and the national entity, leading to an expansion of decision-making spaces for municipalities and states that entails new functions, such as relationship management with international organizations and deal with the pandemic, in addition to a potential constitutional reform in the Brazilian federative pact.

Nesse sentido, a partir da utilização do método histórico, propõe-se que tal impacto vem em sentido diverso do que ocorria desde a promulgação da Constituição de 1988, dado que existe um movimento de descentralização que, neste momento, opera em sentido oposto ao de centralização que já havia estabilizado e seguia sendo mantido, inclusive pela jurisprudência do Supremo Tribunal Federal (STF). Essa mudança de direção se daria em função do protagonismo de governadores e prefeitos mediante a tomada de decisões administrativas e legislativas, por um lado, e por decisões do STF, por outro, o que cria uma expectativa de saber se tais movimentos são meramente eventuais ou podem estar a estabelecer um padrão para o futuro da federação brasileira. Para construir o arcabouço de fundamentos que embasam os resultados do artigo, fez-se uso de revisão bibliográfica, de análise da legislação e da distribuição competencial havida na Constituição de 1988, além da recente jurisprudência do STF. Conclui-se, com fundamento em tais acontecimentos e de modo não peremptório, que há falta de planejamento no processo de descentralização atual e consequente intensificação na competição entre entes subnacionais e o ente nacional, o que leva a uma ampliação dos espaços decisórios dos Municípios e dos Estados, com novas funções, como o relacionamento com organizações internacionais e o enfrentamento da pandemia, e a uma possível reforma constitucional tácita no pacto federativo brasileiro.El artículo presenta los impactos de las decisiones tomadas por el Estado brasileño desde el inicio de la pandemia por coronavirus que han afectado la federación brasileña. En tal sentido, mediante el método histórico, se plantea que el impacto viene en contravía de lo que ocurría a partir de la promulgación de la Constitución de 1988, en virtud de haber un movimiento de descentralización que, en este momento, opera en sentido opuesto al de centralización que ya se había estabilizado y se mantenía, incluso por la jurisprudencia del Supremo Tribunal Federal (STF). El cambio de orientación se daría en función del protagonismo de los gobernantes por medio de la toma de decisiones administrativas y normativas, por una parte, y por decisiones del STF, por otra, lo que genera una expectativa de saber si estos movimientos son meramente eventuales o pueden establecer un nuevo estándar para el futuro del país. Para construir el andamiaje de fundamentos que basan los resultados del artículo, se empleó revisión de la literatura, análisis de las normas y el reparto competencial contemplado en la Constitución de 1988, además de la reciente jurisprudencia del STF.
