The following article seeks to present and sustain the concept of State of exception as a modern creation that is updated in the context of the current pandemic, as it complies with the validity of the ideas of progress. The method used was of a philosophical nature, which appeals to the concept of wondering, from which the possibility of revealing reality from the hidden recovery unfolds. The results of the reflection have to do with the reaffirmation of several points: the sovereign as the creator of regulations that undermine the human condition; the State of exception and its risks in the preservation of precarious lives and the normative and abstract overflow in times of the current pandemic. As important conclusions of the work, it is highlighted how paradoxical the State of exception can be since, on the one hand, it is created to protect the concrete life and, in turn, uses it to respond to exceptionalism, and on the other, it stands as a possibility of returning to a past, ignoring the responsibility of renewal for building a different future.

O método utilizado é de corte filosófico, o qual apela ao conceito de “assombro”, do qual se desenvolve a possibilidade de revelar a partir do exercício de recuperação do oculto da realidade. Os resultados da reflexão estão associados à reafirmação de vários pontos: o soberano como criador de leis que debilitam a condição humana; o estado de exceção e seus riscos na preservação das vidas precárias e o abuso normativo e abstrato em tempos da atual pandemia. Como conclusões importantes deste trabalho, é ressaltado a contraditoriedade do estado de exceção, visto que, por um lado, é criado para proteger a vida concreta e se vale dela para dar resposta à excepcionalidade; por outro, é erigido como possibilidade de retorno a um antes. Assim, a responsabilidade de renovação para edificar um futuro diferente se torna óbvia.El presente artículo busca presentar y sustentar el concepto de estado de excepción como creación moderna que se reactualiza en el marco de la actual pandemia, en tanto obedece a la vigencia de las ideas de progreso. El método empleado es de corte filosófico, el cual apela al concepto de asombro, desde donde se despliega la posibilidad de develar a partir del ejercicio de recuperación de lo oculto de la realidad. Los resultados de la reflexión tienen que ver con la reafirmación de varios puntos: el soberano como creador de normativas que socavan la condición humana; el estado de excepción y sus riesgos en la preservación de las vidas precarias, y el desborde normativo y abstracto en tiempos de la actual pandemia. Como conclusiones importantes del trabajo, se resalta lo paradójico del estado de excepción en tanto que, por un lado, se crea para proteger la vida concreta y se vale de ella para dar respuesta a la excepcionalidad y, por otro lado, se erige como posibilidad de retorno a un antes.
