The Spanish Civil Code is the supplementary Law in the case of a legal loophole, that is to say when a legal rule or a custom do not exist or are not applicable to the case.La presente aportación analiza el sistema de fuentes del Derecho vasco, tal y como resulta de la reciente ley 5/2015 de 25 de junio de Derecho civil vasco. De acuerdo con ella, las fuentes del Derecho civil vasco son las disposiciones de la propia ley, la costumbre y los principios generales del Derecho vasco. No lo es, en cambio, la jurisprudencia, cuya misión es depurar e integrar los preceptos del Derecho civil vasco.
