What is the material context of constitutional order? The purpose of this paper is to offer an answer to that question by sketching a theory of the material constitution. Distinguishing it from related approaches, in particular sociological constitutionalism, Marxist constitutionalism, and political jurisprudence, the paper outlines the basic elements of the material constitution, specifying its four ordering factors. These are political unity; a set of institutions; a network of social relations, and a set of fundamental political objectives. These factors provide the material substance and internal dynamic of the process of constitutional ordering. They are not external to the constitution but are a feature of juristic knowledge, standing in internal relation and tension with the formal constitution. Because these ordering factors are multiple, and in conflict with one another, there is no single determining factor of constitutional development. Neither is order as such guaranteed. The conflict that characterizes the modern human condition might but need not be internalised by the process of constitutional ordering. El propósito de este artículo es ofrecer una respuesta a esa pregunta esbozando una teoría de la constitución material. Distinguiéndolo de otras aproximaciones relacionadas, en particular el constitucionalismo sociológico, el constitucionalismo marxista y el derecho político, el artículo describe los elementos básicos de la constitución material, especificando sus cuatro elementos estructurantes. Estos son, primero, la unidad política, cuya forma dominante sigue siendo el estado-nación moderno; segundo, un conjunto determinado de instituciones, que incluyen, entre otras, tribunales, parlamentos, ejecutivo y órganos administrativos; tercero, una red de relaciones sociales, que incluyen a los intereses de clase y los movimientos sociales, y; cuarto, un conjunto de objetivos políticos fundamentales (o teloi). Estos factores proporcionan la sustancia material y la dinámica interna del proceso de ordenación constitucional. No son externos a la constitución, pero son una característica del conocimiento jurídico, que se erigen en una relación interna y en tensión con la constitución en su sentido formal. Debido a la multiplicidad de estos factores de ordenación y a que encuentran en conflicto entre sí, no existe un único elemento determinante del cambio constitucional. Tampoco ellos garantizan el orden en cuanto tal. El conflicto que caracteriza la condición humana moderna puede, pero no necesariamente debe, ser internalizado por el proceso de ordenación constitucional.
