This paper will analyze the value of such immunities, focusing, in first place, on the existence of a rule of customary law of non-recognition of immunities before international criminal tribunals, and secondly, it will focus on the possibility that the Security Council’s referrals entail an implicit waiver of immunities.La competencia del Consejo de Seguridad para remitir asuntos relativos a crímenes de agresión cometidos en territorio de Estados no parte o por nacionales de Estados no parte abre la puerta al análisis del valor de las inmunidades de los altos cargos del Estado frente a la CPI, que vendrían a ser los autores materiales de dichos crímenes, ya que el reconocimiento absoluto de dichas inmunidades dejaría prácticamente sin efectos las remisiones de los mencionados asuntos por el Consejo de Seguridad.
