The article examines the power that the Criminal Procedure Code gives the National Police to inform the media about the identity of the accused; and analyzes if this faculty affects the right to the presumption of innocence enshrined in the Political Constitution of the State and the Code of Criminal Procedure, in order to demonstrate that, in this aspect, the guarantee of a democratic criminal system is null and has serious negative effects in the person, in terms of labeling and stigmatization for the construction of the enemy. |
