The Law of Prior Consultation, enacted in the Government of Ollanta Humala, is taken as an object of study, and it is argued that this inclusive policy is actually imbued with coloniality, a concept that will be developed throughout the article. Following this line, it is argued that due to the application of Eurocentric concepts in a different context (Latin America), an adverse and counterproductive effect is achieved that leads to a policy of exclusion. Finally, it is proposed as a solution that the State should embrace a different policy, precisely that of promoting and respecting a true self-determination of indigenous peoples.Tomando como ejemplo los sucesos ocurridos durante el Baguazo, en el presente artículo se hace un profundo análisis de la situación jurídico-social de los pueblos indígenas en el Perú.Se toma como objeto de estudio a la Ley de la Consulta Previa, promulgada en el Gobierno de Ollanta Humala, y se sustenta que esta política inclusiva, en realidad, está imbuida de colonialidad, concepto que será desarrollado a lo largo del artículo. Siguiendo por esta línea, se aduce que debido a la aplicación de conceptos eurocéntricos en un contexto diferente (Latinoamérica), se consigue un efecto adverso y contraproducente que desemboca en una política de exclusión.
