This new labour contracting tool aims, directly and indirectly, to renew, update and adapt the historical institutions of Labour Law to an increasingly flexible labour market. Smart working seeks to become an important technological innovation within the employment contract, modifying concepts that until a few decades ago seemed indisputable.Hace mucho tiempo que la tecnología de la información ha ingresado al ámbito del trabajo, producto de esta incursión aparece pocos años atrás el smart working en Italia, como un modo de ejecución del contrato de trabajo subordinado, que como toda novedad ha ocasionado grandes expectativas, pero también ha evidenciado puntos de controversia que poco a poco van esclareciéndose.
