In this article we try to describe from a lawyer’s
perspective how blockchain works, as well as its
main characteristics and possibles applications
in a simple way. Furthermore, due to their
importance in the future of legal world and business
relationships, this paper explains smart contrats
and its characteristics. Moreover, it analyses how
blockchain coul work in government services
and administrative procurement, more specially,
in public procurement. This analyses considers
the existence of regulatory limits — legislative
changes are needed to use blockchain technology
to some cases—. Also, we propose the application
of blockchain technology to public tenders,
for example by desinging a bockchain-based
contractor´s registry or by issuing a publicly
verified bockchain-based indentity credential
to contractors —they are just our propossals—.
Blockchain can bring to public procurement
transparency, inmutability, auditability and
integrity. In adiction, it is important to study
how smart contrats can be used in the public
procurement. However, there is still a long way
to go before we will be able to implement some
of these ideas |
