Laburpena: In the current period of strong tensions between a nationalist and illiberal paradigm and the very idea of "Union by law" the principle of the rule of law assumes a central dimension. In order to be configured as a rule of European society’s cohabitation, this principle has to be reworked in the dual direction of dialectical tension with democratic norms, on the one hand, and of dialectical comparison with "common constitutional traditions", on the other. This essay aims to analyse these identity issues using the new écart methodology.
