Summary: This paper analyzed the control carried out by the Court of Auditors on bids and contracts. The central question that guided the research was to understand how the Court of Auditors should carry out the control of public procurement in the contemporary State, where one of the tonic is the scarcity and containment of public expenditures. In this context, the work covered: i) themes related to the current challenges of the State; ii) some prisms in which the scarcity can be located, correlating them with the fundamental choices of society; (iii) the legal dimension of the efficiency principle; and iv) how external control can contribute to the good governance of bids and contracts. In conclusion, it was argued that, in times of scarcity, the state should be called upon to make maximum with minimum resources available and the Audit Courts should assist in this by combating waste of public resources and deviations.
