Summary: The topic of corruption, especially when involving public contracting, has become a recurrent issue in the Brazilian press since bidding processes are often manipulated to conceal illicit acts. Based on a bibliographical research, considering the reference survey already published on this topic, as well as using the qualitative method, this paper seeks to analyze, concisely and objectively, the corruption from social and political points of view – emphasizing the repercussions in the social and political environment –, and legal point of view – considering the Brazilian Criminal Code and the Anti-Corruption Law (12.846/2013). The main frauds in bidding will be analyzed, thus exemplifying them with concrete cases. It is concluded that bidding processes have become a real simulacrum of corruption, where corrupt people/companies and corrupt bureaucrats use the bidding process to relegate the public interest to the benefit of private interests, failing to curb institutionalized corruption in the most diverse segments of society.
